When does email become mere electronic data?
I know that ones personal email is protected by law but I have heard that such protections last for only so long. After a period of time, I read somewhere, email becomes only electronic data on file and is NOT subject to privacy protections. Has anyone heard this before?
Thanks!!
HI-
Yes, those protections that dictate that a search warrant must be used. What I read (on the internet, so it MUST be true!) is that after a period of time that email isn't considered private correspondence and a search warrant isn't needed by law enforcement officials. I didn't know about a subpoena being all they need for a civil case, though. It's been very hard to find that again on the internet.
But you do bring up good points about email in general. I think we forget how non-private such correspondence really is. (And I NEVER use my work email address for personal use, especially when I complain about the company!).

What "privacy protections" are you referring to? All email sent on your work computer is subject to being viewed by your company at any time, whether it is on a "work account" or your personal account. If you send an email during work hours, assume your boss is reading it.
Any email sent at home can be retrieved through a Search Warrant during a criminal trial or Subpoena during a civil trial such as a divorce.
Never consider email "private". If you want something private, call them. Once it is in writing it is out there for anybody to see.
