Would an American jury convict a man for shooting the Westburo Church protesting his sons (a soldiers) funeral?
Not that I'm advocating it. But I think they would be hard pressed, especially in the south, who would put a man in prison if he snapped and starting shooting if the Westboro Church came out with their "Thank God For Dead Soldiers" signs.
If you were called into the jury. And you looked across the room at this heartbroken man who wasn't allowed to bury his son in peace. A son who gave his life for his country. And who kept a pistol, with permit, under the seat of his car.... And the defense attorney made a really good case of temporary insanity. Would you put him away?
If we start excusing killings on the basis of "well, the defendant was provoked" then where do we stop? Will we see killing excused on the basis of "he dissed me, man" or domestic violence excuse on the basis of "dinner was late" next?
No matter what the provocation may be, we are responsible for our own actions. The only justification for killing is that it is necessary to protect yourself or others from being killed.
